Oral Proceedings before the EPO

Oral Proceedings (or OP) are almost always the final event of a procedure, whether during examination, opposition or appeal proceedings.

They are always a formal affair, and an important feature of them is that at the end of the mostly one-day, but sometimes two-day procedure, an oral decision is handed down, to be followed later by the detailed written decision.

The EPO has three official languages, namely English, German and French. Which of the three official EPO languages the OP is conducted in depends on the a number of circumstances which are elaborated here.

OP’s are regulated by Art. 116 EPC and Rules 4, 115, 116 and 124 EPC.
