Patent applications - before filing

Patents may be regarded as strategic assets because their legal anti-competitive effect safeguards and improves the competitive situation and earning capacity of the patent owner.

The patent owner can choose either an offensive or a defensive patent strategy.The primary aim of an offensive patent strategy is to establish broad patent protection thus effectively dominating the business area in question and providing the patent owner with a fixed-term monopoly in the territories covered by the patent. The defensive patent strategy, on the other hand, also prevents others from patenting in a certain field but the patent application is filed with the aim to destroy novelty for subsequent applications filed by competitors.
