In order to obtain an SPC, you must have a granted patent (basic patent) and a marketing authorisation for the product covered by the patent protection in the country in which you apply for an SPC. When the basic patent expires, the protection period of the medicinal product may be extended by means of an SPC which takes effect upon expiry of the basic patent.
An SPC can be obtained for medicinal products and plant protection products covered by a patent for:
- the product as such
- a method for producing the product, or
- a use of the product
